These terms govern your use of Colordex ("the Software"), an Adobe® Illustrator® extension provided by Bartlebe ("we", "us"). By installing or using the Software, you agree to these terms. Your purchase is also subject to the Adobe Creative Cloud Marketplace terms and the terms of Adobe's payment provider, FastSpring.
Upon purchase through the Adobe Creative Cloud Marketplace, we grant you a non-exclusive, non-transferable license to install and use the Software. Unless the listing states otherwise, the license is perpetual for the version you purchased.
You may use the Software for personal and commercial design work. You may not redistribute, resell, sublicense, rent, or publicly share the Software package (.zxp) or any license code, and you may not decompile or reverse-engineer the Software except to the extent applicable law expressly permits.
We may provide updates at our discretion. Updates are covered by these terms unless delivered with separate terms.
The Software — including its code, design, and the "Colordex" name and logo — is owned by Bartlebe. "Adobe", "Adobe Illustrator", and related names are trademarks of Adobe Inc. Colordex is an independent product and is not affiliated with, endorsed by, or sponsored by Adobe Inc. References to Adobe Illustrator are for identification and compatibility purposes only.
Colordex is designed to operate non-destructively (edits apply to copies and are undoable). Even so, you are responsible for keeping backups of your files, and you should always verify final output — for example, your PDF/X export reviewed in Acrobat's Output Preview — before sending work to print. Colordex provides first-pass checks and does not replace professional prepress verification.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BARTLEBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR PRINT/PRODUCTION COSTS, ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE.
Purchases are handled by Adobe / FastSpring; refunds are governed by their policies. Please refer to the Adobe Creative Cloud Marketplace and FastSpring refund terms.
These terms are governed by the laws of Japan, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. The Adobe Creative Cloud Marketplace and FastSpring terms also apply to your purchase.
